After relocating to New Hampshire from Nebraska in 1990, Kelly joined a southern New Hampshire firm where her practice was devoted primarily to commercial litigation. Since the formation of Gagliuso & Gagliuso in 1995, her practice has been heavily concentrated in construction and business litigation, and today her efforts are devoted largely to representing general contractors, construction managers, subcontractors, suppliers and sureties.
Kelly has developed a practice spanning the full range of legal issues arising out of commercial and industrial construction, bidding and negotiation of contracts for construction projects of all kinds and sizes, from schools to industrial plants, from retail to large, multi-use developments. She enjoys guiding clients through the legal issues encountered at all stages of the design and construction process.
Dispute resolution is also an important component of Kelly's practice. She endeavors to resolve disputes before they disrupt a business relationship and require formal resolution procedures. In the event that early resolution is unsuccessful, however, she is an experienced litigator, prosecuting cases in state and federal courts, as well as in private arbitration hearings. Her litigation experience includes preservation of lien rights and pursuit of payment for delays, disruptions, changes, improper termination and other contested legal issues.
Kelly is active in trade organizations related to the construction industry. She serves on the boards of directors of the Granite State Chapter of the National Association of Women in Construction and the New Hampshire Good Roads Association. She is a member of the American Arbitration Association's Construction Advisory Council and serves on the Education and Recruitment Committees of the New Hampshire/Vermont Chapter of Associated Builders and Contractors. She frequently lectures and publishes articles on construction industry topics.
Kelly is also an active member of several professional organizations, including the Nashua, New Hampshire and American Bar Associations. Her membership in the ABA includes frequent participation in educational opportunities offered by its Forum on the Construction Industry. Kelly graduated from the University of Nebraska at Lincoln with a degree in Secondary Education in 1987. She earned her law degree from the University of Nebraska College of Law in 1990. She relocated to New Hampshire and was admitted to the New Hampshire Bar the same year. Kelly lives in Amherst with her husband, Rick, and their daughter, Rachel. |
